Well, Tony skirted the lines a bit. They were so-called "private issues", taken from the Max Steiner Music Society transfers of the Steiner discs in direct cooperation with the Steiner Society. There were never any rights clearances done. All the previous CDs (from overseas) are from those same tapes or the 2-LP set. The cue you mentioned is "Fedelia" on our album. However, I think you will find the quality substantially improved over what was issued by the MSMS, on Tony's LP set, or the subsequent international dingi (plural for dingus).
Don't get me wrong about Tony. He was a pioneer in sparking interest in classic film scores and his private issues were done in an era when little interest was otherwise shown in this "old stuff" (although I don't think anybody at Fox was fooled when he claimed on the jacket of his CAPTAIN FROM CASTILE album that the tracks were from the old Mercury recordings). I still prize my complete set of his albums, which included his radio interviews with many great stars of old and with Maxie himself. He was also a fan of Frank Skinner, which makes him a good guy in my book any day!
I have quite a stack of Tony Thomas's albums including (I think) all the Steiner releases. Did you know Ted Gilling of Toronto? By the way - you just sold me on your release!!
Goodness - finally received and listened to the SAE version. What a wonderful job. This is my 2nd favourite Steiner score of all-time and Ray and company have done an incredible job of rescuing and restoring these original tracks. I confess - I a/b'd it with the old 'unmentionable' and the SAE job blows that away!!!! This is well worth picking up, gang.
Very good Steiner score (and I'm not a big Steiner fan). Fantastic in the film. This is the greatest booklet from SAE yet. I thought their booklets in the days of Captain from Castile were good but calling THIS a "booklet" is an insult. It's just like the one in Tribute's Adventures of Don Juan.

Yavar
This is a Max score which you can listen to from beginning to end. It's also that rarest of film music birds - one where I can abide the repetition present simply because the melodies are so grand you can't get enough of them.
By the way, the tapes for Captain from castille were provided by Lionel Newman, who thought the Fox trackas were what was used for the Mercury. When he found out different, he gave Tony a stern warning.
