So, a four note thing by Baxter is Williams stealing his music. I don't think so, sorry.


Eight notes in the B development, not the main statement.

I'm astonished the Herrman estate never sued Danny Elfman for stealing the entire opening from Journey To The Centre Of The Earth and using it in Batman.

That`s probably because the Herrmann estate doesn`t own the music. Usually the film company owns it.

But as the composer he is still entitled to his share of royalties. And as the case with Rozsa/Dragnet, Miklos was able to sue for use of his music without his permission. I would think the same right would apply to Herrmann?

Not actually film music, but Wild Man Fischer successfully sued Paramount for using his song "Merry Go Round" without his permission in the VHS release of the film MEDIUM COOL. All subsequent home video releases of the film, including the recent Criterion Blu-ray, have replaced that song with "Sweet Georgia Brown" (heard in the film's Roller Derby sequence).

No, it is because the statement about Elfman "stealing" is idiotic, imbecilic and just plain ignorant!

That is similar to the arguing over Holst's "Mars" and GLADIATOR.
Both cases involve a distinct, staccato 5/4 rhythmic motif - NOT a truly distinctive melody line
