Speaking of the package- just curious- What was it? i.e. if you dont mind? It's obviously the 'Swedish sure-grip suck machine' as mentioned on The Naked Gun 2½, especially if it was wrapped in brown paper.* * Equally of course, it might be something completely different

Yeah, I'll echo the 'don't drop the eBay case' until you're actually reimbursed, since eBay recovering your money from the seller will be your last recourse if FedEx doesn't come through, and once a case is closed it can't be reopened. I also wouldn't leave any better than neutral feedback for this seller for being so uncooperative when it came to filing a case with FedEx him/herself. This is one reason that I chose to rent a private mailbox at a nearby Postnet. I receive enough packages from online transactions that it's easily worth the ~$220/year to ensure that my items are always delivered someplace reliable, where there'll always be a person there to physically receive it and e-mail me to come pick it up.

I'm sorry, but someone has to speak up here about the eBay seller. This is not a seller problem and no claim should have ever been opened against them. They shipped the package. Period. Really. It's very wrong to have opened a claim. The seller is willing to cooperate but I don't blame the person for not wanting to until the claim is dropped. On what basis has this claim been opened anyway - the seller, if they are smart, will win this because THEY can provide the Fed Ex proof of shipment, which is all they are required to do. It is shocking to read some of these entitled replies. It sounds like Fed Ex will make good, but if they are to make good it's the seller who will make that happen so MY advice is to immediately drop the claim that should never ever have been made and frankly I'd apologize for it.

It's sticky situation, and I can empathize with both parties. About 10 years ago, I sold a CD for over $100 on ebay and the buyer paid via Paypal. He claimed the CD never arrived, but according to the USPS tracking number it was delivered to his residence. He opened a Paypal claim, but Paypal found in my favor based on the delivery confirmation, so he wasn't granted a refund. At the time I suspected that he was trying to get one over on me, but I'll never know for sure. In fact, the buyer in this case already had one negative feedback rating from a seller who stated that the buyer claimed an item never arrived and demanded a refund, which bolstered my suspicion (this was back when sellers weren't handcuffed and could post negative feedback for unscrupulous bidders). A few years ago, I bought a CD for $2 plus S&H on ebay and paid via Paypal. The CD never arrived despite the fact that the USPS tracking number showed that it was delivered to my residence, so after contacting my local post office over the phone and getting the run-around, I contacted the seller and asked for a refund. He refused based on the tracking information. I asked if he would send a replacement CD, since he was selling multiple copies of the same CD at the time for the same low price, and again he refused. Based on my previous experience (and the minimal monetary loss), I didn't bother to open a claim. Had I spent $100, however, I wouldn't have been so quick to shrug it off. Either way you look at it, dragon53's is an unfortunate situation in which there is no easy remedy and which there may be no amicable resolve for both parties unless the item is eventually located and delivered to him as it should have been in the first place. Ultimately, as the carrier that was paid to provide a service that wasn't rendered, FedEx should step up and take responsibility.

After three weeks of dealing with FedEx, the ebay seller and ebay, ebay gave me a courtesy refund for the entire purchase price of $114. As I posted before, FedEx originally listed the package as being "Delivered. Left at front door.", but when I denied having received the package, the FedEx driver gave three different accounts of delivering the package: 1. Delivered. Left at front door. 2. He saw me open the door and get the package. 3. He gave the package to someone who just drove up. The ebay seller refused my request to file a claim with FedEx. A week later, FedEx Trace Dept. then called me and confirmed the package was not delivered, and I should file a claim. I forwarded this information to the ebay seller in hopes they would now file a claim, but I got no reply. I then filed a claim with FedEx, but FedEx wouldn't proceed with the claim until the ebay seller sent in a one-sentence claim waver. The FedEx rep emailed me a letter that I was to forward to the ebay seller requsting the ebay seller send in the claim waver, but the ebay seller apparently did not, so I escalated the claim with ebay. Ebay said they would refund my money if I filed an internet crime report in that the package was probably stolen after being left at my door. I filed the crime report and gave the report number to ebay to receive my refund. Three days later, I called ebay about my refund and was told they're still waiting for my crime report. I told them I gave it to ebay three days ago (ebay lost it) and gave it again today. My refund arrived later. FedEx lost the package, the ebay seller wouldn't cooperate, but at least ebay refunded me the money out of their own funds. I'm glad this had a happy ending. Lesson learned----avoid merchants who ship via FedEx no-signature required (although the ebay seller said it was being shipped via USPS). My Toyota 2000GT from YOU ONLY LIVE TWICE.
