I need some input regarding a FedEx delivery problem.

Last Friday, the FedEx driver left an ebay package ($114 value) at my door. Because the seller didn't require a signature, the FedEx driver left the package at the door, and it was apparently stolen. I don't have the package. I contacted the seller who told me it's not their fault.

The FedEx driver stopped by today, and he said he left the package, knocked on the door and saw someone open the door and pick up the package. I told him I didn't pick up the package, and I don't have it. He told me to call FedEx.

I called FedEx and was told they put a tracer on the package and will call me back tomorrow. Assuming the package isn't found, I was told to ask the seller to file a claim with FedEx for reimbursement. However, since the seller didn't require a signature, the chances of reimbursement aren't good.

So, any suggestions on my next step?......(i.e., if I escalate my claim with ebay, under the circumstances, what are my chances of reimbursement?).

I don't have an authoritative answer but it sounds like you might be out of luck here. Unless Ebay rules state all packages must be insured. (Which I thought they did nowadays?)

Other wise a seller isn't responsible as long as the package was shipped to the right location. I don't believe any mail service, FedEx, UPS or even USPO will take any responsibly either unless it was insured for loss or damage. (though I can tell you USPO screwed me and a seller over when a package was insured but destroyed by them, and they refused to pay up.)

The only outstanding thing here is FedEx guy saying he left it at the door and saw someone open the door and bring it inside, and you saying this never happened. Not sure where you can go with that. It's a he said/he said situation.

Well since you never received the package and it is lost, it's not your responsibility. I'd demand to be reimbursed and provide the seller with as much info he or she needs to try and get a claim with FedEx. FedEx is obviously in fault here as I am sure it is not customary to leave a package in front of the door, signature or not? Over here, if you are not home, they will try with the neighbors and leave a note in your mailbox or simply leave a note stating when they will return or where you can pick it up.

If you paid via paypal (or creditcard with insurance), file a dispute to make sure you get your money back.

Even so (which I find questionable practice), the customer did not receive the package, Fedex can claim all they want, if you are persistent enough I'd say try and get your money back. Ebay (especially paypal) will most likely side with the customer and since it is not registered mail the seller is disadvantaged here.

However, this is whats called "driver release", meaning the driver believes the location is safe enough to be left and not be stolen, so he signs it or releases it himself.

If you have the tracking number, look it up on FedEx's website. It'll likely say something like "LEFT AT DOOR". This means that the company is still liable because its their driver/representative who last had it.

(As to USPO, that is separate since they're a branch of the Federal Government and tampering with mail is a big freaking NO NO. UPS and FEDEX are private, independent firms.)

Unless Ebay requires insurance on all packages I don't see what recourse you would have. But of course don't take anyone's word on here. You should email or call Ebay and get an official response from them.

I was in shipping and receiving for over a decade and saw this a few times a year.

Call FedEx. Their driver was the last one to handle it, proof of delivery is totally on them. For all you know, the package was accidentally or purposely opened in shipment and the driver took it and marked it as delivered.

Similarly, I can't tell you how many times I've had something go missing - only for it to be delivered days later because the driver scanned it and never dropped it off because he was in a rush.

They were the last ones to handle it, they were the last ones to see it, it was with their service, the burden of proof is on them, not you.

UPDATE:

I talked to FedEx's Trace Dept. who told me to tell the ebay seller to file a claim with FedEx.
Hopefully, the seller will be reimbursed and then reimburse me.
I don't know what the chances are FedEx will pay on the claim since the driver claims he saw me pick up the package.

"I have no problem starting a case with fedex but would apreciate you dropping the case with ebay as they are holding my funds and i held up with my end of the purchase and mailed the item to you. Get back to regarding this issue. I will let you know what goes on with fedex."

Any suggestions?

I think he is saying he will file a case with FedEx on the condition you drop the Ebay dispute with him first. It's up to you.

In which case I would most certainly not drop the Ebay dispute. You know already what FedEx's story is going to be: the driver saw someone retrieve the package from your residence. If the seller sent a package valued over $100 without requiring a signature for delivery and the package was then stolen from your doorstep the responsibility is on him.

Reading about this stuff just pisses one off. I remember walking near my apartment in Alameda last year and watched a UPS guy fling a package from the sidewalk up to someone's porch. Ridiculous.

GUYS:

FedEx's website list my package as "Delivered. Left at front door.", and since I don't have it, it was likely stolen.
I'll have to see if stolen packages are covered in ebay's Money Back Guarantee program.

UPDATE:

FedEx Ground Trace just called me. They were telling me to file with ebay and the FedEx rep mentioned the driver's official account is: as he was leaving my apartment, he left the package with someone who just drove up in the parking lot. I told the rep this is totally different from the driver's original version from Monday that he saw someone open the apartment door and pick up the package. He also called his supervisor on his cell phone in my presence and told him he saw someone (i.e., me) pick up the package at my door. Now his new version is that someone drove up in the parking lot and got the package---that's FedEx's THREE different versions of what happened.
I requested the rep tell her superiors that the driver has totally changed his account of what happened, and she said she would.
